Terms & Conditions | Win ‘Every Gardener’s Dream Getaway’ For Two with Hoselink x Merribee 

Introduction 

1. The Hoselink competition is promoted by Hose-Pro International, ABN: 33 096 552 751 Address: 1/108 Old Pittwater Road, Brookvale, NSW, 2100, Australia. Ph 1300 900 617
2. 2. The promotion commences on 09:00 AEST 4th September 2023, and entries close 23:59 AEST 18th September 2023.
3. Anyone who enters the Competition (an "Entrant") will be deemed to have understood these Rules along with the Terms and Conditions and will be bound by them.

Eligibility to Enter 

4. The competition is open to all Australian residents aged 18 years or over. Friends and Family of Employees of Hose-Pro International or Merribee and any persons deemed to have an association with the promotion are not eligible to enter.
5. By entering the competition, you confirm that you are eligible to do so and that you are eligible to receive any prizes that may be awarded to you.
6. It is also a condition of entry to the Hoselink x Merribee competition that entrants agree to receive Hoselink marketing material. 

How to Enter 

7. The maximum number of entries that can be awarded to a person is 80.
8. Entries can be made via the links hosted on www.hoselink.com.au/win
9. The entry mechanisms include: 

• Submit your answer to the question “Let us know in a few words, why you should win the Gardener’s Dream Getaway at Merribee Gardens?” – 20 entries  
• Subscribe to Hoselink’s newsletter – 5 entries 
• Subscribe to Merribee’s newsletter – 5 entries 
• Subscribe to Hoselink’s SMS notifications – 10 entries 
• Make a purchase over $99 at Hoselink.com.au – your entries will be doubled!   

The Prize 

10. The grand prize will be distributed to one winner, to the estimated total value of over AU$5,000:

• 2-night stay in the Silo luxury accommodation (one bedroom) for 2 people at Merribee, 660 Comerong Island Road, Numbaa NSW 2540, Australia (Merribee.com.au). The winner would need to share the one double bedroom with their guest, if they choose to bring one.   
• Breakfast included both mornings for up to two people.  
• Private history of gardening talk with owner & founder of Merribee, Lucy. 
• Private garden tour with Head Gardener at Merribee Gardens, Beth. 
• Full-day private gardening masterclass with Hoselink’s resident horticulturist Ben Hayman. 
• Gardening products for the gardening masterclass (supplied by Hoselink) for up to two people.  
• Morning tea, a gourmet picnic lunch and afternoon tea supplied on the gardening workshop day for up to two people.  
• Travel cost for up to two people within Australia up to the value of $2,000 will be covered.  
• Prize fulfillment dates are subject to availability and at the discretion of Merribee. 
• Merribee’s preference is to have the winner (and their guest) stay in November 2023, but if that doesn’t suit, they will supply a list of alternate dates once the winner is chosen.  

11. The prize is non-transferable and non-exchangeable, and no cash alternatives will be provided.
12. We reserve the right to substitute prizes of equal or greater value if circumstances beyond our control require doing so.

Winner Announcement 

13. The winner will be chosen based on two criteria:

- High entry points, and 
- the participant’s answer as to why they deserve to win.  

• The winner will be announced on Tuesday 19th September 2023.  
• Hoselink will make two attempts to contact the winner via email. 
• If the winner does not respond to the emails informing them of their win within 14 days of the second email, they forfeit their right to the prize, and Hoselink reserves the right to select and notify a new winner. 

Data Protection and Publicity 

14. As a participant, you agree that any personal information that you provide when entering the competition will be used by Hose-Pro International for the purposes of administering the competition. 
15. If requested by Hose-Pro International, the winner agrees to release their first and last name and their email address. 
16. The winner’s first name will be announced on Hoselink’s social media channels.
17. All information collected may be re-used for marketing purposes by Hoselink and will not be passed onto any third party.
18. Only if the participant chooses to subscribe to Merribee’s newsletter, this information will be shared with Merribee, but not with any other third party.

 

Limitation of Liability 

19. Hose-Pro International accepts no liability for any damage, loss, injury, or disappointment suffered by any entrants as a result of participating in the competition or being selected for a prize.
20. The Promoter (Hose Pro International & Merribee) and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

• during the draw; 
• whilst undertaking any travel won connected with their entry into the draw; or 
• in the participation in any prize 
• as a consequence of late, lost or misdirected mail; 

21. Participants in the Getaway Competition acknowledge and agree that the competition is in no way sponsored, endorsed, or administered by, or associated with, any third party besides Merribee, including social media platforms used for promotion.

Indemnity 

22. Participants agree to indemnify and hold Hoselink, its officers, employees, agents, and representatives harmless from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses, including legal fees, arising out of or in connection with any breach of these terms and conditions.

Release 

23. By participating in the Gardener’s Getaway Competition, participants release Hose-Pro International from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the competition or the prize.
24. Please note that these terms and conditions have been drafted to comply with Australian law, and participants in the Gardener’s Getaway Competition are encouraged to seek legal advice if they have any concerns or questions regarding their rights and obligations under these terms.

General 

25. Hose-Pro International reserves the right, at any time and without prior notice, to cancel the competition or amend these terms and conditions.
26. By participating in this competition, participants agree to be bound by these terms and conditions.
27. Hoselink is not responsible for any lost or misdirected entries or technical malfunctions that may occur.
